It is a great lesson we need to learn while investigating or handling the aftermath of an accident on a construction site. They include:
- Prepare prior to the event. It is important to be prepared prior to the accident by having a checklist of best practices to follow in case the accident happens. This will include identifying the order of command to be used for notice purposes identifying the members of the internal investigation team and identifying who will serve as a spokesperson for the company, as well as identifying the risk management group (insurance as well as legal).
- Take care in the event of an accident. Don’t waste all your time preparing prior to the accident only to not adhere to the procedure you’ve established. The case of County of Galveston v. Triple B Services, LLP and a decision the 26th of May, 2016 on May 26, 2016, the Court of Appeals of Texas looked into a claim by a contractor to recover damages from an expansion of a road. The contract also allowed to pay “delay damages” if the Contractor’s request to be compensated for the damage “is determined to be compensable.”
